TERMS AND CONDITIONS

By booking an order with us or making a purchase, whether in person, over the phone, email or by our social media platforms you are agreeing to be bound to our company policies. It is the responsibility of you (the customer) to review our policies as they relate to your order or purchase. These terms form the basis of the contract between our customer and Irresistibly Scrumptious Treats. These terms, your order and your order confirmation are considered by us to set out the whole agreement between you and us for the sale of our products. It is your responsibility to check all details in the order confirmation are complete and accurate as this is the document we work to when we complete your order. 

CHANGES TO YOUR ORDER

If you need to alter any aspect of your original order then please let us know as soon as possible. We will always endeavour to adjust the design or any other changes of your order where possible. However, under some circumstances this may not be possible according to the notice given and the supplies needed to complete the adjustment. 

If the alteration affects the cost of the product or preparation has already begun for the original design or product then your balance will be adjusted accordingly.

We reserve the right to change the design at any point if circumstances are beyond our control and if the overall quality of the product may be compromised, e.g. melting due to very hot weather. 

Each product is made by hand so although every effort is made to ensure consistency, some variation may occur. 

 

OUR PRODUCTS 

All of our products are made by hand and accordingly there will be minor variation in appearance. All photos, illustrations and descriptions provided or displayed on our official accounts are for guidance only. 

From time to time certain materials we use for our products may become obsolete. This is totally out of our control. We will do our best to select replacement products to reflect the original material as closely as possible. We reserve the right to replace items with component parts of equal or better quality without consultation. 

SHELF LIFE 

All of our products are prepared and baked as fresh as possible for every order. We cannot guarantee the quality of our products if consumed more than the advised consume by date provided for each product. 

Our products are made entirely of natural ingredients and it is for this reason they will not have the extended shelf life of most supermarket products of the same nature which contain additives and preservatives. 

In order to keep your products in optimum condition they must be stored away from sunlight and refrigerated for our cupcakes and cakes. 

Other products must be kept at room temperature unless advised otherwise. 

Once cut, your cake should be consumed within 3 days. We do not recommend that you freeze our cakes or cupcakes as we cannot guarantee the quality once frozen despite being safe to do so. 

All of our products should be stored on a flat surface and stored correctly as advised in relation to each product in either the boxes provided or a suitable alternative.

Please note sugar paste and fondant may crack as it dries out which is out of our control and why we recommend you consume your products in the advised time frame and store them correctly. 

ALLERGIES AND DIETARY REQUIREMENTS 

Please discuss with us if any of your guests or recipients have special dietary requirements or allergies. Some of our products can be made without nuts, dairy, eggs or alcohol but please be aware that all of our products are prepared in a kitchen that uses all of the above alongside gluten and other allergens. 

Therefore, we are unable to guarantee that our cakes are 'free from' these ingredients due to the risk of cross contamination. 

TRAVELLING WITH YOUR PRODUCT 

We strongly advise against placing any of our products on the seat of a car as seats are slanted and can damage the products

Our products should be placed in either the boot or the footwell of your vechile or alternatively on a non slip mat. 

Extra care should be taken when driving as some elements of our products may be delicate

Irresistibly Scrumptious Treats do not take any responsibility for damage to our products when collected and transported by their customers. 

GIFT VOUCHERS 

All gift vouchers are valid for 12 months from purchase. Gift vouchers have to be presented at the start of the ordering process.

All postage of vouchers is to UK addresses only. Please allow 3-7 days for vouchers to arrive in entitlement to refund or exchange. 

It is not possible to extend the voucher validity beyond the stated 12 month validity period. 

Vouchers must be presented in printed form. Vouchers cannot be used on seasonal products or certain promotional days and periods. Please ask for more information of these periods upon ordering.

Availability is subject to change, gift vouchers can only be claimed where availability for products and dates below. 

Vouchers can be used as either part payment or full payments for products. Vouchers are non transferrable, non refundable and non replaceable. 

Vouchers can be split over multiple orders until the limit of three orders is reached. Any remaining monetary value left on a voucher after the order limit of three orders remains non exchangeable.

Where gift vouchers are dispatched by email or post, Irresistibly Scrumptious Treats cannot be held responsible for lost, undelivered vouchers or if details are not entered correctly.

Irresistibly Scrumptious Treats reserve the right to amend these terms and conditions without prior notice. 

CANCELLATIONS 

In the event of a cancellation the deposit or order total will be transferred to a new date dependant on enough notice being given and the new date having availability. 

We, Irresistibly Scrumptious Treats, will not be liable for any failure to perform, where such failure or delay results from any circumstances outside of our reasonable control including but not limited to any fire, flood, explosion, accident, adverse weather conditions, lock out, hostilities, non availability of materials or supplies, traffic congestion, mechanical breakdown, obstruction of any private or public highway, riot, government act, act of war, terrorism, act of god, any form of industrial dispute or strike whatsoever or anything out of the outside control of Irresistibly Scrumptious Treats.  

In the event of exceptional circumstances, such as serious illness, Irresistibly Scrumptious Treats will give as much notice as possible if we are unable to fulfil your order. We will endeavour to find someone else who can produce your order and will refund you any monies already paid. If for whatever reason you cancel your order after the final balance has been paid, unfortunately no refund will be given. Payment is required for any and all expenses already incurred on behalf of the finished product.

If you wish to postpone your order, please let us know as soon as possible. Your previous booking will be considered cancelled and will be subject to our cancellation policy above and a new booking will be placed for a new date. 

If you wish to rebook for a new date this will be subject to any price increases since the original booking was made. If you are postponing more than three months in advance than any monies paid over will be carried over to your new date.

WHOLESALE INQUIRIES

If you'd like to stock our products, please send us an email using our Contact page. Please include details of quantity, products, flavours, location etc when messaging.  We aim to respond to all enquires within six hours. 

DEPOSITS 

In order to secure your order we require a 50% deposit when booking orders over £10. Orders worth under the value of £10 have to be paid in full when ordering. Once paid this deposit is non refundable and can be transferred to a new date dependant on the availability for the new date and whether enough notice has been given. 

Without this deposit we are unable to secure your booking and your space will be available for someone else to book.

The final balance of your order will be due two weeks before your order is due to either be collected or delivered. If this balance is paid late it is considered a breach of contract by the customer. 

We reserve the right to hold the older until payment is made in full. When payment is late we accept no responsibility should we be unable to purchase the required stock or equipment made as close as possible to the order confirmation as possible with no redress or liability on Irresistibly Scrumptious Treats. No contract is made with you, the customer, until the 50% deposit has been made. Once the deposit has been received you are in a legally binding contract with Irresistibly Scrumptious Treats. 

ORDERING INFORMATION

When ordering any of the products pleas estate the day that you would like to either collect or have your products delivered. Please have an idea of a design for custom products, how many you'd like to feed, flavours etc and if you have any reference photos please send them to us when ordering. 

NON EDIBLE ITEMS 

Some of our products will contain a small proportion of inedible items. It is the customers responsibility to ensure that these are removed by either yourself, designated party or caters before the product is consumed. 

This includes but is not limited to fake flowers, support dowels, ribbon, wires in sugar flowers, flower picks, flower tape (where real and fake flowers are used).

Some flowers such as Ivy are poisonous and are not suitable for use on food products. 

It is the customers responsibility to notify your florist that you intend to use fresh flowers on a cupcake or cake to ensure that non poisonous food safe flowers are supplied for use. 

PHOTOGRAPHY 

On occasion we will photograph our products with the intended use to use these photographs for display, any form of advertising including web based promotions, broachers, galleries and competitions without compensation to you, the customer. 

DELIVERY 

The cost of delivery will be dependant on postcode of the address you, the customer, would like delivery too. If the address is changed by the customer and is a further distance, additional delivery costs may apply. 

We cannot be held liable for any damage to your order once we have delivered the order and it has been accepted by the designated party. 

We take photos of our products at every angle for our own insurance purposes as proof of the condition of the product upon delivery. 

If the product is ordered as a gift the party who ordered the product will be sent photos from every angle and be liable to accept the order is in perfect condition before it is delivered. 

RETURNS AND REFUNDS

ALL SALES ARE FINAL. Absolutely no refunds or exchanges will be given. We are not responsible for damaged products once the product has left our hands.  

Once the designated party has either collected an order or accepted a delivered order it is consider accepted. 

Refunds requested due to decorating style, writing, colour shade, or general design will not be honoured after accepting your order.

If you try one of our products and just don't care for it, we hope you will try something different next time and a  refund will not be given as taste is subjective.

We are not liable for any refunds due to catastrophic events beyond our control. Please refer to our 'Cancellation' policy for further details on this. All monies paid over will be transferred to a new date or a refund provided (less costs incurred) if we unavailable for a new date. 

LOYALTY CARDS 

Loyalty cards cannot be used in conjunction with any other offer or promotion unless they are specified as being part of Irresistibly Scrumptious Treats loyalty card scheme. 

Loyalty cards are valid for one year from issue. If the loyalty card has not be filled within this time and products unclaimed will be voided automatically. 

Loyalty cards must be presented at the time of ordering.

Loyalty card points or stamps can be collected on orders over the value of £10 and can be redeemed on the products stated on the loyalty cards only. 

We reserve the right to exclude certain products from the loyalty card scheme

A maximum of £10 can be collected which equates to one stamp per one order in a twenty-four hour period. 

Loyalty cards remain the property of Irresistibly Scrumptious Treats and must be returned to us or destroyed at our request. 

Loyalty cards are non transferrable and can only be used by the person that the card as been registered too. Only one card will be issued per person. 

When the loyalty card has been filled a new one will be issued.

If the loyalty cards are lost, Irresistibly Scrumptious Treats are not liable to replace it with a new loyalty card.

Irresistibly Scrumptious Treats reserve the right to amend or withdraw the loyalty card and loyalty scheme without any notification. 

Information will be held on our records but will not be accessible to any other third parties in accordance with the Data Protection Act. 

COMPLAINTS 

Any refunds given for disputes are at the sole discretion of Irresistibly Scrumptious treats and are not automatic. Full refunds will never be given. 

All products are photographed at every angle to prove the quality of our products in the case of any dispute and for our own insurance purposes. 

We do not accept responsibility for the loss or damage to any of our prodcuts if they have been delivered to the provided address intact or collected from or premises. 

If you have any concerns about your order or product please let us know at the earliest opportunity, i.e. on delivery or collection of your order so that we have the time to rectify any changes. 

All products require either a signature on collection or delivery or a written message of acceptance. This indicates that you are happy with the product received. If you are not happy please ensure that you make this known when accepting your order. This provides us with the opportunity to correct any problems

We are not responsible for any mistakes made by the customer such as but not limited too incorrect spelling or misspelled names or incorrect choice of flavour or product

We always keep samples of our products for a reasonable time. In addition we take photographs of our products prior to delivery or collection. 

Complaints are extremely rare and to date we have never received one. All complaints will require further investigation. Products involved in a complaint must be returned to us within 24 hours to ensure that we are able to fairly assess the nature of the complaint. 

The product must have been stored at the correct temperature and stored correctly as advised, out of the sun, away from damp conditions unless stored in a fridge and away from heat sources. 

At least 75% of the product must be returned to us uneaten, within 24 hours of delivery or collection. 

Both parties agree to not post any negative information about the other or products arising out of this contract or event on any online forum, social media platform or website without providing advanced written notice of the intended content thereof. As well as providing the other party with a prior opportunity to resolve any issues between the parties amicably. Please note we will only deal with the customer who placed the order.
